What I've Learned About Unemployment in Massachusetts

DO NOT PURCHASE ANY HEALTH INSURANCE THAT FAILS TO MEET MASSACHUSETTS MINIMUM CREDITABLE STANDARDS. The policy I described in this post originally, is not a valid policy and should not be allowed to be sold in Massachusetts. Through a legal loophole, it is technically legal to purchase, but if you purchase such a policy, the state will fine you up to $1000. If you must purchase private health insurance, go to the Massachusetts Health Connector website for more information and ensure that the policy you purchase meets those minimum standards as described in my more recent posts linked above.

No legal advice. This blog post relates my experience only. I cannot advise anyone as to their rights or help them with their situation. Please do not ask me for an opinion.

Rachel Levy and I have both been blogging about our searches for work. If you know anyone looking for a marketing professional, please go visit her site and hire her. My blog is not only about looking for work--check out the archive to see the breadth of things I've covered in the past two years...but today, I want to talk unemployment.

The Massachusetts Division of Unemployment Assistance website has a great deal of information, but there is very little to answer the specific questions real job seekers have and no way to actually do anything of value there. Once you have filed your initial claim, you will be able to go online to file your weekly claim. But in the beginning, there are so many simple, basic things they do not tell you. So I'm going to list what I've learned here and invite people to comment and fill in the details...

Top 7 Tips for the Unemployed in Massachusetts

My purpose here is not to tell you how to find a job. It's just about the hoops you need to jump through to get the insurance benefits you are entitled to receive while you are looking for work. I recommend you just do these things and don't get hung up on lots of questions or debates about why the system is the way it is. We have a pretty good deal in Massachusetts compared to other states, so check your attitude at the door and don't let the bureaucracy and cesspool of negativity you may encounter distract you from finding a job.

Follow up:

1. Go stand in line. Or, more accurately, sit in your car holding a number. Do not bother with the phone; it is busy. There is no way to register online and no forms to print out. So rather than call and wait on hold for hours, what you should do it go down to your local "walk in center" in the middle of the day and ask them when the line forms, then come back the next day at 7am or so to get a number. Then go get a coffee from Dunkin Donuts and come back at the right time. Make sure you bring all the information you will need to fill out the form. When I filed my claim, the center was experimenting with a group filing approach; we all filled out our forms together and I was out of the building within half an hour. Then, later that day, I received a call from the intake person to confirm he had registered me in the system. Easy. Painless. No frustration.

It would be nice if the form were online so I could fill it out in advance, submit it online, or even just mail it in. It seems ridiculous to have to stand in line to get a form that you fill out and hand to a person, then leave.

2. File your Medical Security Program application ASAP. If you are receiving unemployment benefits, you may be eligible to participate in the Medical Security Program. Download the application form, fill it out, and send it in before you file your initial claim. If you are eligible, MSP will reimburse you 80% of your COBRA premium up to a monthly maximum of $1080 for a family plan or $440 for an individual plan. My COBRA plan would cost me $1312.92 per month for Blue Cross HMO Blue Enhanced Value.

Are you eligible? Probably, especially if you have kids. But the determination of eligibility is complicated so rather than try to figure it out, just get the application completed and filed ASAP along with any required supporting materials...like the letter you need your wife to write saying she is a stay at home mom.

Download the brochure and application form and read them carefully. The website itself does not give the details you need. But get the application in so have it ready if you need it. If you fail to submit the application right away and find you need health care, the state will not pay retroactively; a friend I know is already in for $2600+ with the state refusing to reimburse the COBRA payments he made before his application was processed. You can file an appeal--another great use of your time when you could be looking for a job.

3. Wait for your first unemployment check to arrive before you try to call MSP. I burned through 45 minutes of cell phone time (I do not have a land line) before I got to a person who said she could not help me until I had received my first check. It will probably be a month before you get a check and maybe 6 weeks before you learn anything about MSP. In the meantime, you will be hoping you don't get sick, avoiding going to the doctor, and not electing to use your COBRA "benefits." You have 2 months from the date you are laid off to elect COBRA and it can be retroactive. So, if you have an emergency, you go to the doctor then pay COBRA.

If you do qualify for MSP, you will have to front the money for COBRA premiums and get reimbursed. And I do not know how part time work affects your eligibility for participation in MSP, but I suspect it is not good.

4. The Commonwealth Care program is irrelevant to you. If you are eligible for MSP + COBRA, you are not eligible for Commonwealth Care. You can use the Commonwealth Connector web site to shop for private insurance, but you will not get the low-cost or free health care that is available for people who did not just lose their jobs. It is interesting to note that this site shows me many options cheaper than COBRA, but none as good as the NASE plan.

5. If you find part-time or consulting work...manage your time strategically. It is a crime to fail to report that you worked and earned money while unemployed, and you are allowed a pittance of earning (1/3 of your benefit amount, e.g. a couple hundred bucks), but what typically happens is if you make any significant money, you lose your benefit for that week. So if you do manage to find some freelance work, make sure you do it all in one week. Don't do something foolish like work 10 hours a week for 4 weeks. Schedule your work so that if you have a 40-hour project, you can do it all in one week.

6. Stay positive. It is easy to get upset when you are on hold forever and then the phone hangs up on you or the person who answers refuses to help you. It is frustrating to click on website links that claim to give you information on how to apply...but then don't link to the forms. And it is terribly frustrating to listen to repeated hold messages telling you to go to the website...when the website is telling you that you have to call the phone number. But just do what you need to do and get back on track looking for a job!

7. Don't feel like a scumbag. I try to laugh at the movie Office Space and recall the line from one worker who is afraid of being laid off:

I'm going to be the first one they're gonna lay off. Just the thought of having to go to the State Unemployment Office and having to stand in line with those scumbags!!!

There is no shame in collecting unemployment. We've been paying into the system for years--or at least our employers have been paying for us. It is social insurance, designed to cover just this situation. It's not a government handout.

In the 1930s, perhaps our grandparents gave up their dreams to provide for their families during the Great Depression...they put their college degrees away and found jobs doing laundry or whatever it took to keep their families fed. There was no safety net and dreams were deferred out of necessity. But that generation enacted social protections to help prevent that kind of thing from happening again. For a few minutes, the lucky among us who had good jobs, stand in line with the laborers and attorneys, ironworkers and accountants, in these challenging times, and focus on building a better future with a least a few months protection from losing our homes and freezing in the cold because we were only a paycheck away from disaster. If there are some hoops we must navigate, we do it, and we move on.

I work for the Commonwealth Connector Authority and just wanted you to know that you understandably confused the Health Connector with one of our two core products, "Commonwealth Care." "Commonwealth Care" provides subsidized health insurance for those who earn below a specific level of income.
We have another product, "Commonwealth Choice," which provides unsubsidized health insurance coverage and for which is increasingly popular as an alternative for those looking for an a more affordable option for COBRA coverage.

Dave, this is a great post.

We filed the MSP paperwork the day after my husband was laid off. Because of the long wait currently for the first unemployment check to arrive, I'm not sure it's the best thing to wait to apply. We got accepted a couple of weeks after the first check arrived (which was about 5 weeks from the last day of work.) Also, it should be noted that according to one of the MSP telephone agents, you WILL be accepted to the MSP if you meet the qualifications.

The wait right now on the phone line is crazy. But we have been able to get through twice. We called late in the day and right BEFORE lunch with decent luck. We still had to wait a long time - not advised, of course, if you need to manage your minutes. :)

Another big misconception is that you cannot file an unemployment claim if you were given a severance. Not so! If you had to sign a general release, which you probably did, you can file the claim right away. This is key when you may be off work for awhile like in this craptacular job market.

When I got laid off, back in '05, the people on the phone were very helpful and I got my check promptly.... my guess from hearing about your experience is that these days things are slower due to increased volume!

My tips: If you actually want to find a job, do more than the legally required minimum weekly job search. Do a LOT more. Looking for work is just about a full-time job. And don't get discouraged -- it takes time to find a job, and even more time to find one that's right for you.

Great tips, Dave, and much of it is spot-on. As a current recipient of UI (on the federal extension, as I dried the state well), I'd like to amend your second bullet about the MSP.

There are two MSP options: premium assistance and direct coverage.

You wrote about COBRA reimbursement which is the first option. But, even if your previous employer offers COBRA, if you can prove that the cost (before reimbursement) is too pricey for your monthly expenses and cost of living, then you may be eligible for the second option.

That's what I'm on. When I was laid off last year, the COBRA choice was over $400 a month which I could not afford. I mailed-in the requisite paperwork and showed my monthly expenses. The state approved my waiver and signed me up for direct coverage through Blue Cross Blue Shield's Network Blue Preferences plan.

In other words, while the premium assistance plan covers up to 80% of COBRA, I'm paying diddly squat a month for a no-frills basic health insurance plan that only costs me money if I visit a doctor or need drugs.

It's not an option for everyone, as you need to meet certain guidelines of the federal poverty level... but that, too, can be waived with the right paperwork.

One item I have many questions around is the whole idea of consulting income. I did a small project for someone this week. I'm going to invoice them at the end of January. And then, someday, they will pay me. When do I report that work? If I report it now, I will not get benefits for this week and I'm not sure when the client will pay me.

Update: received my first check on Friday. I noticed my bank account had increased...so I checked and sure enough, my first unemployment benefit was direct deposited on 1/23. That's just 15 days from the day I went down to the walk-in center in Norwood. Frankly, that's pretty impressive; I have to give the unemployment office credit. But my point in this blog post is that you need to figure out what to do and they don't make that easy. When you follow the process, you CAN get results quickly.

Heres the question I cant find online...

If you get laid off on monday, the first of the month and file the same day at the walk in office, when do you start getting paid?

For instance, does the week I got laid off on count as my waiting period if they paid me for that day... 200.00?

If not, does that mean the week I got laid off on doesnt count and the following week would be the waiting period, so the third week of the month would be the first to count and could expect a check for it on the fourth week?

I was laid off on Nov 13th of last year and began filing for unemployment on 11/15/08, and have been filing every week since. I still have not received my first check (and have even setup direct deposit to hopefully expedite things). Do you, or does anyone who is reading this post have any idea how long this actually takes? I know that I should expect a lump sum when the checks do arrive, which will help tremendously - but now I am 3 months behind on rent and the landlord is ready to throw out myself, pregnant wife, and 16 month old child.

I am completely depressed and desperate for answers. I have called, stood in line, called again, and stood in line some more. "Your claim is still processing" is the ONLY thing they will tell me. And I mean the ONLY thing they will tell me. The case workers have actually told me to go home and be patient. I have spoken with my previous employer and they filled out all the paperwork correctly and did not contest anything. I even took the papers to the post office myself and mailed them 2 1/2 months ago to be sure.

I do feel exactly like the scumbag from Office Space. It feels like I'm being singled out somehow. I'm looking for IT/Network jobs diligently while also trying to take care of my son during the day (we've had to remove him from daycare), and have no idea how much longer I can keep this up without pay.

Please, anyone - can you offer any answers.....? Thank you so much to anyone who can help.

This is in response mainly to "unemployed, frustrated, and about to get evicted." Get yourself over to Transitional Assistance as soon as possible. My check was also quite delayed and I qualified for emergency food stamps. These are things beyond our control and there is no shame in accepting needed assistance. I only needed it that one month and it eased my mind and kept food on my table. They also have other programs that may be available to help with your pending eviction situation. I'm very surprised no one at unemployment suggested this to you. They suggested it to me when I asked what could I do if I ran out of money before my unemployment came through. Hang in there!

Hi Dave and "therese",

I wanted to thank you very much for the responses. If you can believe it, I finally got a call yesterday from a case worker from Springfield who needed clarification on my case. What had ended up happening is that they never got the paperwork, or that it is in a pile somewhere and it hasn't been processed yet. The woman I spoke with was incredibly kind and caring and she manually approved and released funds at the time of the call. She even apologized for the extended delay and worry it caused, but I know it couldn't have been her fault. The timing ended up being more than perfect, and our landlord is very happy. I did contact Transitional Assistance and they did offer great information and contacts.

This blog helped reassure me that the system does work, so I wanted to thank Dave personally for writing it. Luckily, my wife still has medical insurance through her job, so we have always been ok there.

Thanks again, and let me know if there's any way I can help or give details about my experience. Whoa, now I can finally breathe a bit easier. The great news is that I had a very promising interview also yesterday, and I'm positive for our future.

Thank you to everyone who read my post and reached out. This is the type of togetherness we all need in these troubled times. And yes, I would have had no problems accepting the food stamps, as I'm willing to do whatever it takes to provide for my family. I can only imagine that no one in the Quincy office suggested these programs because they too have been so overwhelmed with applicants. It's just hard to stay positive when you feel like there is no help. Now I'm convinced that together we can get through this!

I am an industrial designer who was laid off in November and have been collecting unemployment.
I have the opportunity to take on freelance work but I am uncertain if I will be able to continue receiving benefits after I complete the contract work. I understand that if I report my wages I will not receive benefits for that week. My concern is that if I take on a larger job, making well over my benefits say $1000/wk for 4 weeks, can I still collect benefits after this job is complete or will I be considered self-employed if I earn too much in a short period?
I want to take on the work but I don't want to risk losing my benefits entirely. any help is appreciated.

Here is how it works...you can earn up to 1/3 of your benefit amount before they start reducing your benefit. So, if your benefit is 600 and you earn 200, you will still get a check for 600. If you make 201, you get 599. If you make 800, you become ineligible for benefits. After becoming ineligible for benefits, you have to telephone the unemployment department to re-file your claim for the next week, if you have no freelance work. They will ask you if you worked...if you say yes, $200, then you are eligible again. Then you have to separately go on Sunday and fill out the web form. The best way to do this is to call early Saturday morning to re-file, then go online Sunday to report your weekly claim. When you go to the website, it asks you the questions, were you available, did you look, did you work. If you answer yes/yes/yes, then it asks you to report how much money you made less expenses. So, in theory, you could have made $300 in freelance income, but if you have $100 in expenses, you would report $200 and still be ok to receive your weekly check. You are supposed to report the work at the time you do it, regardless of when or whether you are paid. In my case, I did a small amount of freelance work last week and I won't even invoice for it until March 1, but it does not matter. Report the income when the work is performed. If you have a very flexible project, it would be to your advantage to work in such a way as to report, for example: 200, 200, 800 per week instead of 400, 400, 400 for example. I am NOT advising anyone to lie, but if you can schedule the work in this way, it will help you maximize your benefits. It is a bit cumbersome to have to reopen the claim because you can only do it by telephone, but just because you make a lot of money one week does not permanently make you ineligible. So make the call on Saturday morning. I've been able to get through quickly on Saturdays while I was dropped many times during the week. Hope this helps!

I worded for 40 hrs 2 yrs ago....collected benefits....then rehired for 25 hrs and found a part time job for 17 hrs for a total of 42 hrs and now my 17 hr job cut down to 12 hrs.....therefore only working 37 hrs.
can you collect benefits for the 5 hrs that i have been cut.....

Thank god I found this blog. I have been receiving benefits for being unemployed but recently got a freelance gig and could find nothing on the Mass workforce site to clear up the confusion of freelancng mixing with benefits.

I know you have covered this subject a lot Dave but just wanted to verify that if I take a week long freelance gig report the wages earned I will have to RE-FILE the following week for benefits? I can't just do the weekly online or on the phone claim Sunday the next week when I do not work and say I did not work and begin picking up my unemployment again I have to actually refile? Sorry just trying to verify?? Great info though!

Yes, you have to call on Saturday, then go to the website the next day to actually make your new claim.

for example, here is what I did:

week1: $0 earned, go to web page on Sunday and report that, get direct deposit on Tuesday.

week2: $2000 earned through freelance gig., go to website on Sunday and report. no benefit that week and benefits "cancelled"

week3: $225 earned, call phone number on Saturday; tell them you need to reopen claim. They take down information and say, "ok, you are eligible again, call back tomorrow." Sunday, go to website and fill out form reporting $225. Benefit is reduced because, apparently, the 1/3 amount allowed is based on your base benefit, not allowing for dependents. Direct deposit of reduced benefit on Tuesday.

week 4: $187.50 earned, go to web on Sunday, report, full direct deposit on Tuesday.

I have a question. I was layed off in August of last year...got severance that lasted me through 2008, thank goodness. I filed for unemployment at the beginning of January..it took about 6 weeks and then I finally got the payments and have been using the online system weekly....the same week the checks arrived, I found out that my company was paying me a small bonus (due to me for the year 2008 when I was still working there) and the company direct deposited it into my account...when you fill out the questionnaire for UI, there is nothing about compensation for the previous year coming in..do i have to declare this? and how? I left a voicemessage for the person that worked my claim (she needed a copy of my release for my severance) and she hasn't called me back...

Need some help. I just filed for UI on 2/24/09 so this is considered my first week which I won't get paid on. My question is in regard to a check I will receive dated for this week for a commission owed to me for a sale I made in December 2008, which was delivered on 2/11/09, which I am now being paid on. My question is, even though I received this check during my first week when I am ineligible to collect a check anyway, does it still count as income for that week even though the income was for a sale that occured while I was still employed in 12/08. I was laid off on 12/26/08 and filed a claim on 2/24/09. I waited becuase I knew this check was coming and I was going to try and do free-lance work, but it wasn't working out so I filed. Can anyone help?

This is a great blog and I'm glad I found it! I got laid off last week (2/28) and I have a couple of questions and you all seem to know this so well...

1. I might be getting a part-time job - so as long as I don't go over 1/3 my unemployment pay a week - my claim won't be cancelled and I can file regularly on Sunday?

2. I'm confused about COBRA. My COBRA paperwork is in the mail and I want to apply for the MSP...how does that work? I pay for COBRA and if I am accepted into the program, MSP will reimburse 80% of my COBRA premium for that month? Why does it matter if you go to the doctor? Isn't COBRA retroactive to the beginning of the month that you are paying for? I understand that the MSP won't reimburse you for COBRA payments already made before acceptance, but why are you out money if you use your COBRA benefits before acceptance into the MSP?

3. What about the stimulus - isn't the government subsidizing 65% of COBRA premiums for people laid off between 9/1/08 and 12/31/09?

I also have a question:

I was temporarily laid off at the end of January for one month. I applied for and received unemployment benefits for the last 3 weeks of February.

I returned to work this week for 1 day, and was then permanently laid off.

Do I just report the 1 day's wages this Sunday (slightly over the 1/3 limit) and receive the reduced benefit amount then just continue filing each week...or do I need to contact unemployment and somehow close/reopen the claim as a permanent layoff?

This was covered above, but only on a one week basis. Anyway, I have been collectine unemployment for a couple of months. I have an opportunity to work a contractor gig for 2 months or so. However, that will be the end of it for sure. Can I reopen the claim after that long? I have heard that once youopen the claim, it can be closed/reopened again for the duration set by the unemployment rules -- I think it is 30 weeks, plus an extension of 20 weeks or so. I just want to know if taking this short contracting job for 2 months will close my claim forever.

Reading the above posts, it sounds like the delay between filing and actually starting to receive benefits is 6-10 weeks. Is that what others are seeing? I wouldn't be at all surprised if the backlog were getting longer, given the volume of claims they're getting. I've been out of work for a month, and while it's not a crisis for me yet, I'm wondering when the payments will start to show up.

Actually, there should be no delay. I filed on a Thursday (in early January) and had my first claim payment deposited 10 days later.

The problem is just that it is extremely difficult to get through to a person if you have a situation that cannot be handled in an automatic fashion.

I am seeking information on the Massachusetts Unemployment web site. I already filed a claim with the UE Office in person and obtained a pin number. Today, Sunday I have been struggling all day trying to file my first claim. I kept getting a Server 500 Error all day long and unable. My IE 6.0 is up to date and all other web sites work perfectly fine. Has anyone had this experience with the state's unemployment computer. There hours are Sun - Fri 7 AM to 7 PM with extended hours till 10 PM on Sunday. Anyone know what the best time or day to do the weekly claim or report? TIA Bob.

I filed for unemployment 2/5/09 and still no check! My bills are all past due, I have a 4 month old at home and rent is coming due. All the info I can get is my claim is still being processes. Others from my work laid off at the same time have not received checks either. And my cousin is at 9 weeks and no check. How are people supposed to live? Is there anyone I xan contact to get my check faster? Thanks.

If the internet is giving you trouble, you can always call Telecert. The number is 1-617-626-6338, you need to have your social and pin in order to claim the previous week. You can do it sunday through friday 7:00am - 7:00pm. You must stay on the line until you hear "your weekly claim filing is now complete." Hope this helps.

Filed for Mass UI on 3/11 in person at their walk-in center. Filed my first weekly claim online 3/16. Today received a piece of mail from the UI office today with a booklet and a work search log. I thought by now they would tell me about my benefits. I am aware I should be receiving a letter of benefits determination if I am correct? Does anyone know how long it takes get the letter of benefits determination? I am aware I am probably on the unemployment computer system by now. Also hearing or reading that other people claims the state is so backlogged processing benefits for the claimants. Fellow co-workers who get laid off with me are on the same boat. Last time I collected was 15 years ago and things were much different back then and moved quicker but you had to wait in a long line that stood all day and weekly claim was done by mail. Any feedback greatly appreciated. I will also share back with others how long I been waiting for my first payment. Stay positive. TIA -Bob

Once you are in the system, things should move more quickly. When I am able to file a weekly claim online on Sunday, the direct deposit shows up on Monday or Tuesday. The big challenge is if you have to talk to a person--i.e. reopening a claim, etc. The phone line is totally hit or miss--one time I was connected right away, most of the time, I'm on hold for a long time until they drop the call. I posted another post here about waiting on the phone... I am going to post a new item now that summarizes all these articles.

Thanks for taking the initiative and offering this important information. Like Jon who posted on 3/9, I have been unemployed since November. Recently I was offered a consulting gig that will last for 2 months. I am concerned about taking it because once it is over there is a very good chance that I will not have another assignment lined up. Furthermore--this assignment is part compensation and part commission (I will not know how much commission for months)---My question--can I take the 2 month gig and then reopen my claim? Just an FYI, UI is currently backlogged 4 to 6 weeks, and you are posting a 10day wait period for your check. I also have filed 2/26, gone to the office, and called, with 2 children it is getting tough. TA is also backlogged, and currently there is no "Emergency Status" I got harassed about My son in college not working, so he is ineligible,and my ex-husbands income (he has been out of work since 11/08)
All my worker could say was, I am sorry you will just have to wait, we are very behind

I just want to post what I learned and went through with my Mass. UI experience. First of all, I was laid off on March 6th with a bunch of other people. On Wednesday March 11th I went to a walk-in center began a file along with a group orientation they said was mandatory. The next thing I did was I began doing my weekly claim on Monday March 16th for the weekending March 14th which was my waiting week and I do not get paid for that week. Immediately after I did my file online, I immediately setup my account to receive direct deposit. On Tuesday, March 17th I saw that 0.00 was deposited into my bank account but I think that was a test deposit so that UI office can verify and confirm everything. According to the direct deposit FAQ their web site it does says it takes 9 days to setup a direct deposit and during that time any benefits due to you will be mailed by check. I also received my letter of Benefit Determination saying how much I will get and for how many weeks etc on Saturday March 21st. I then did my 2nd weekly claim for the weekending March 21st on Sunday March 22nd at 7:00 AM. I have noticed that UI computer system is very slow on the weekend for some reason. The computer did say a check was issued for March 23rd for such and such an amount. I expected a direct deposit and went crazy checking my bank account Monday and Tuesday until I received my check in the mail today this afternoon. I did not expect this, but if you read the Direct deposit FAQ on their web site it will tell you it takes 9 calender days before it goes in affect. I followed up with other co-workers and it appears that the ones who went to the walk-in center in person and began a claim are on the same boat with me already receiving benefits. The ones who started a claim on the phone were missed. I am now aware that filing a claim on the phone can be a hit or a miss and it may be the reason why people are not getting benefits by now. The other thing I can think of is maybe the employer has not immediately responded back with the UI office and that's probably why some might be seeing a "backlogged" excuse. I would dig deeper into by checking with supervisors of an UI claim office if that's the case. I just wanted to share this experience with anyone seeking feedback. Hope this was helpful.

I received UI benefits in MASS for the better part of 2008. I was laid off in Jan '08. In addition to working at my full time job (which I received UI after losing) I am a musician. I've had songs placed in tv/films throughout the years and receive quarterly royalty checks in '08. These amounts vary but usually it's about $700 to $1,000 every four months. In filing my taxes this year I'm looking at the 1099 my publishing company sent me (total: $4,000) and I'm wondering if I should have declared this when I called in my weekly UI for weeks I received my royalty check; one week in Jan '08, one week in April'08, one week in July '08 and October '08. I didn't actually work - and these are royalties earned from '07 for the most part. I'm very concerned about this. I've searched on line but I cannot find a similar situation. Any advise would be greatly appreciated. I hope this makes sense.

Instead of on The UI websites. I empathize with everyone here. It is a sign of the times for sure when so many are desperately seeking the answer to the same question: "When will I get my unemployment check?" I am into my sixth week of waiting for my first check. I now know that I may wait up to three months or until the end of April. The online UI computer system lags heavily on the day you need to place a claim for that weeks benefits. Obviously this is due to massive volume. All of this is just incredible. With so many filing claims the DUA is hard pressed to keep up with it all. I have been close to despair worrying about whether or not my claim would go through. The answer is now clear. Just be patient and wait. No more anxiety. Why waste the energy? I encourage everyone here to step back and acknowledge that filing an unemployment claim in this recession is going to be a slow and arduous process. All you can do is make doubly sure you filed your claim correctly and be patient. As inefficient as UI services may be realize how good it is for them to exist. Even if we must go through an eternity to get them.

I have a question about how the whole "work search log" thing works:

I've been on unemployment insurance since last year, haven't found a job. I keep the mandatory work search log each week, but I'm trying to understand exactly how it works. From what I understand, I need to provide the work search log "upon request." So, it sounds like you only need to give them the work search log if they ask for it - sortof like the equivalent of getting audited by the IRS for your taxes.

Anyways, I just feel a bit paranoid about this. Has anyone here ever been asked to submit their work search log? Do they ask for a portion of your work search log, or the entire thing?

I hope someone can answer these questions, thanks!

I still haven't received a check or any other correspondence other than UI health insurance info and the work search log in the mail. At the bottom of the screen it says your application is being processed if we need more information you will be contacted. If there is an amount available to me is seems I should be eligible. What could be the hold up?

As several commenting visitors here have noted, there is a requirement to maintain a work/search log and produce it upon request. I don't know of anyone who has had to do this, but I do know of people who have been determined to have been "overpaid" benefits. Then, to contest that determination, you need documentation to support your argument.

If you know of a person who is collecting money "under the table" or is not really looking for a job, you can report them to the DUA. In the case of someone collecting money but not reporting it, I'm sure the IRS would also be interested.

My bf filed his claim back in Nov of 08. He received his first check the end of Dec. Received one more than they stopped, something about a class he had to take. So he took the class. Resumed receiving benefits 2 weeks after completion of class then the checks stopped again. Can not get through on the phone, have gone into a center 3 times and keep hearing "its being processed" you'll be entitled for back pay for the weeks you haven't received but yet here we are in MAY and have not received a check since Feb! WTF!!! He also has sent in his papers 2x now for ins and we have yet to receive any acknowledgment or ins card or anything. Please, can someone help me?

Dave, what happens if I'm getting UI benefits, and then I find a FULL TIME 100% COMMISSION position, but do NOT make any money in my first three to five weeks? That's not fair. Why? Because, while trying to get my feet on the ground in a 100% sales/commission job, I would have to go WITHOUT money until I get my first check from the sales job!!! That could literally be WEEKS and WEEKS while I'm in training, learning, etc...!

Dave, and everyone, please respond to this, because I'm really confused! Is this accurate? Is it REALLY TRUE that if I accept a full-time 100% straight commission job, I will NOT get UI benefits (even if I'm NOT making any money yet)?

The requirement to be actively looking for work has always been there, but I too noticed some language added mentioning the work log. I would recommend going back and filling in your work log if you have let it lapse, but I do not know of any plan to start auditing people more aggressively. When I was unemployed and living in Washington, DC in 1995, we had to submit the work log every week. The requirements for what constitutes a work search are here. As you scan that list...it should be possible for any person who is not actively seeking to defraud the Commonwealth to meet those requirements. Here's a "tough" one:
Using other job search activities such as reviewing job listings on the internet, newspapers or professional journals, contacting professional associations, networking with colleagues or friends.
And here is one I didn't think of:
Reporting to the Union Hall, if this is your primary worksearch method.

I have been collecting unemployment under the "Federal extended benefits" program for six weeks. While validating my weekly claim via the internet I've noticed the wording has changed in questions 1 that deals with the "job search" activity. Apparently, under the extended benefits program the claimant is supposed to mail in the work search log weekly. I just found this out. Has anyone else that is collecting extended benefits mailed in their work search log weekly? If not has the Dept of unemployment contacted you in audit of your work search logs?

Dave, I heard from someone that there is a 2 week waiting period before you could collect. Our company is mandating all employees to take 2 weeks unpaid furlough in the next 2 quarters. We don't get to pick the weeks...we were given 4 to choose from. I'll be taking one week in July and the other in November. So because, in total, I will only have 2 weeks unpaid I can't claim? Only if I had gone into a 3rd week of unpaid furlough?

I was let go back in January of 09 and applied for unemployment benefits. At the time I had a claim from the previous summer so they reopened that claim. Well it took 8 weeks to get a check because I was terminated allthough wrongfully (employee at will in Ma) Longstory short that claim expired on June 6th of this month. I was told I had to open a new claim which I did. I was also told there may be a hold up once again due to the termination from my last employer. Now why is it i have to go through the same big ordeal with them when I already did and was granted benefits. Nothing has changed for me since Janary when I opened it. What is there to review again when its already been reviewed? Also from Jan to June 6 I used 21 out of 33 weeks of unemployment benefits. Am I going to have to go through this once again once the extended benefits kick in after the 33rd week? Will it just automatically kick in? Since I was out of work all of 09 now and 2 months in 08 is my total weekly benefit going to be significantly reduced now? I was getting 625? Will the fact that Ive been out of work all that time significantly reduce my benefit amount? I just feel so exhausted,depressed,defeated by the whole job market and feel kicked around by Mass DUI as well.

I checked with the Division of Unemployment Assistance and confirmed that if you are working with an employer who takes out taxes, you are supposed to report your gross earnings, not net. If you are self-employed, you report the net of earnings minus expenses. This page on the DUA website provides some guidance about earning money while collecting unemployment.

There are many unknowns with regard to collecting unemployment. For example, if while collecting unemploymnet, you attempt to supplement your income and you take on a full-time commission only job - you will likely lose your unemployment compensation - if you can image! The laws need to be adjusted to help individuals not punish them for taking something on that doesn't prove to bring in any money.

Hey everyone, do not be discouraged. I was laid off from Dec 2008 to Jun 2009 and things did work out. What delays there were in paying benefits these weeks were paid retroactive and then continued normally. We were able to get the Direct Coverage through MSP for we could not meet the COBRA payment of $1080/mon. My only gripe was not being able to get any other assistance (TANF) because I "made too much $ from UI" go figure! And what bothered me was the people at the Supermarket using the TANF card for food then driving away in the Mercedes or Cadillac SUV. But that being said I lucked out in getting back to work. Keep the faith.

I filed my initial unemployment claim on June 7th. It's July 4th and I have not received payment. When I log on to check the status, it tells me how much I have in my account but I have not received a check.

I have a freelance job. I worked one day yesterday (Friday) which I will report tomorrow (Sunday). I will be working this freelance job this coming Mon-Fri and I will report this on Sunday. I will be back to making no money the following week so I will re-open my claim that week. (I will make half of my apparent weekly UI wage on that one day on Friday and I will make more than my UI apparent weekly wage in that full week I work)

So..my question is...when I report my wages earned and then re-open my claim...is this going to slow things down even futher? When will I ever get paid????

Do you file every Sunday as directed? You should see during this time the ability to check the status of your weekly claim. If you did not make more than 1/3 of your benefit you should be issued a check. Please check the status page and if needed you might have to call or go to the nearest office in the AM to find out the issue. Hope this helps.

Paul, You should-the amount displayed is your benefit amount allotted to you while on unemployment. Each time you file and receive a check this number will decrease by the amount paid out. Hope this helps.

DTA does, in fact, have emergency expedited Food Stamp benefits. If eligible, you receive them within 7 days of inital claim.

What has changed, is if you file for emergency Food Stamps, you need to re-file within 30 days for the benefits to continue for 6 months. This information was told to me directly by two different DTA case managers while applying at the beginning of last week. I received my first installment by the end of the week.

Stay positive and keep the hope going, everyone. This too shall pass. :)

Just curious. I filed on 6/5 and have not received anything although I have received my vacation pay (reported it) and think that is why my file is so delayed.

I made my initial claim on June 8th. I called UI and spoke to someone about my claim on July 6th. They said I did not report my one week severance I received from my last job (but I DID report it) and that an auditor would be calling me within THREE weeks.

I called UI this morning and the woman that I dealt with was able to provide me my auditor's name (She also said my auditor called on July 8th but I did not receive any calls) but could not locate her number. However she was able to transfer me to my auditor's extension (??). I left a message with my auditor.

I know the auditor is probably swamped but I'm in full panic mode here because I am reaching week 9 of unemployment and the money I do have is running out.

It's frustrating that in order to reach my auditor, I have to call the UI claim line on my designated SS day and wait just to be transferred.

Can anyone give me some tips?

I left my job on 6/17, it was a commission only sales job. I only worked for the company for 3 months. I was promised about 33K to start with more being paid on new business. Let's just say after 3 months it was obvious that what they told me was extremely inaccurate.

I filed on 6/17 and am still waiting to hear from an auditor. I was told 8 weeks. Not sure how they expect someone to survive for 8 weeks while they take their time calling. Granted, I left my job, but I was almost writing them a check monthly to work for them it was so bad.

I actually went to the ue office and when I got there they said that I still had to wait another week or two. She said that it was because of something that my employer said. The ue administrator made me feel awful for asking where my first check was after 6 weeks. She matter-of-factly stated that I still had another week or two before someone would contact me. It seems so long and I wish that I truly could understand the process. Why do some folks receive a check almost right away while some wait. I have worked diligently for 20 some odd years and have NEVER received a check before and had to wait 8 weeks....uuuggghhh...

I did quit my job. but clearly there was a problem since I had been there for so long. Just ask the questions and let me know.

When I finally receive my first check will it be for all of the missing weeks or will it be for only one week?

I just can get any questions even though I actually went to the office. they would give me NO information. I have tried to call and get NO person on the other end. I find this extremely frustrating and maybe they are looking for a good person to streamline the process. UUUUGGGGHHHH....

Hey Lynne, I just needed to respond to tell you that we are NOT surviving this. Unfortunately I filed on 6/17 and am still waiting for my adjuster call. Very upset, no money coming in, no idea how to pay my bils.

The only good/bad thing is I did find a job that I will start on 8/10 which is good, but I would make quite a bit more if I just collected unemployment. I have no choice because I NEED to get some money coming in and have no idea when or if I will get a UI check.

I heard that once you accept a full time job your UI stops. Pretty sad that I would get 1/2 of my weekly wage on UI and by working I will get 1/4 of my weekly wage. I can't survive on that and have no idea what I will do.

Wishing everyone the best of luck and what would happen if I refuse this job because of the low pay?? I bet they would not issue a UI check either....UGH

just wanted to share my update. ive been reading these messages for the last few months for input myself.

i was laid off on june 3rd and filed on june 5th. was told that someone would call me personally within 4 weeks to go over it all or whatever and that i would then start receiving checks and get back pay for that 4 week period.

well i filled out my weekly claim online every week and watched the weeks tick bye. 4 weeks...5 weeks...6 weeks...7 weeks.

now at this point im worried that i missed a call or didnt fill out a form that i needed or something. any calls to the telecenter got closed by the "sorry but we are experiencing a large call volume please try again later" message.

so completely stressed out and confused i waited in line for the UE office to open yesterday. i was not the first few in line so they put me on the list and told me to come back in 2 hours at 10:30am. once i came back they game me a number and told me to wait. once my turn came i spoke with the woman and told her that i had filed about 8 weeks ago and never got my "4 week" call. she pulled up my page on her computer and said that it appeared that i should have been receiving checks according to her records. when i informed her that this was not the case went to ask her supervisor. as it turns out my claim had been approved just a day prior to my showing up at the office. and my check along with 6 back week checks had been deposited into my bank account. had i checked my bank acct that morning i would have seen it but what are the odds of that.

in any case im all set now. im getting weekly checks deposited to my bank and i got all my back pay weeks. it is surprising that it just got approved without the call to me that they said i was gonna get. i guess they are just backed up enough that if they paperwork checks out (when they finally get to it in 7 weeks) that they sometimes dont bother calling.

so anyone in my situation who is wondering what the hell is going on like i was. hope this story helps.

I was laid off June 17th. My employer said to be sure to apply for UI benefits that same week, even though the employer was giving me 6 weeks "transition pay." I filed for UI by phone as directed answering all questions flly and accurately, including stipulating that I was receiving transition pay for 6 weeks. I also checked my claim on-line and put in the same information in the on-line response section, again stipulating the transition pay I was receiving. After 5+ weeks of my claim being "in process", I called DUI and the rep accused me of not having told them about my transition pay(!) I lost my temper and directed her to look at her own records to see that I had repeatedly provided the information. She obviously hadn't checked that. THEN she sent me a letter which arrived less than 24 hrs. later (they can be fast after all, huh?) that said I was disqualified because of the transition pay and would have to reapply for benefits. RE-APPLY? Here's the kicker--another lady at work who got laid off the same day as me and got the same transition pay has been receiving UI benefits during her transition pay period.

Hey Melanie, consider yourself lucky that you had transition pay. Even if you got laid off you would have a waiting week for the first week and then at least two weeks before you would have received your first check, so if you just stopped getting your transition pay, you should have to wait 3 weeks to get your first check. Maybe that is what the UI worker meant?? Not sure.

Just to update everyone, I am now in my 8th week of unemployment. I called to speak with my adjuster last Thursday and did not receive a phone call. I called again today and she had a message on her phone that she is on vacation until next week...UGH

I called the alternate adjuster she left on her voice mail and left a pretty scathing message as to how long are we supposed to wait. I would like to take my son to get school clothes etc but can't afford food or rent while I am waiting on them.

Needless to say I received a phone call within about a half hour from another adjuster. She took all my info...let me know she was calling my former employer and I should not have any problem receiving UI as I had a valid reason for quitting my job.

I am hoping to get my 7 weeks of back pay by next week and can pay my bills, pay all the friends back that I have had to borrow money from for the last 8 weeks, and pay my rent!!

I am starting a job on 8/10 which will pay me significantly less than I would receive on unemployment, but I need money coming in NOW, not whenever.

I did receive a letter telling me the total benefit credit and weekly pay rate.
I have no idea if that means I have been approved and can expect a direct deposit check in a few weeks.

It really is a great help to know it isn't that I have made an error or something.

I managed to get through only once, to find out that a former employer responded that I still worked for them ( likely a secretary in another building that did not know me. I haven't worked there in over a year. I have not received a phone call and feel helpless. Has anyone had a similar experience?

June, you will need to get through to clear up the discrepancy because a person who should not have talked to unemployment gave them false information. Anytime I have actually talked to someone they are looking at a computer with my information on it. Your bass had to report in whenever you last worked.
I was finally contacted 8-10-09 there was an "issue" I'm trying to iron out. "Early retirement" (forced) vs Laid Off. I did find this email but can't vouch that it is what got me a call back.

Fingers Crossed for all of you. I think they are overwhelmed and from what DUI head said on the news the other day that the new people they have hired to deal with this huge increase in applications take a long time to be trained.

My issue is that I have a part time weekend job. I got laid off from my full time job in June. Filed in June. But because I had a part time job also really messed everything up. Over 8 weeks no call. I called the person handling my claim is on vacation. (great) All they need to do is to verify that I am working my weekend job. Yeah I don't get it. So I guess by being a hard worker and trying to balance 2 jobs three kids I get penalized?? This is not fair. If I had only one job I would of got paid by now.?? So if anybody is filing ya might be better off quitting any part time work before filing for your full time job. Not worth, plus they are going to deduct some of what I make anyway from my unemployement from my full time job. Does not make sense because I held this part time job before I got laid off.

Hi, Got a call today from supervisor. She was very nice and apologetic. They only had to contact my part-time employer to make sure I was working still. After waiting 7 weeks 1 hour after I spoke to the an adjuster the amount in my online bank was lowered for about 4 wks payment. She said I would have funds by the end of the week. It is a shame that such a small issue could take so long to rectify. So anybody still waiting there is hope. Do not just wait for a call. Call them atleast once a week. Paperwork gets misplaced. Adjuster go on vacation. Just do not get lost in the system. The are swamped but the squeaky wheel gets heard sometimes, usually in a professional and courtesy way. If anyone needs the adjusters office phone number let me know and I will send to you via e-mail. I did stress out which is normal but do not let it take over your life. Somehow it will work out. I know it is hard to be patient when funds are low. Been ther especially having kids and you have to say no I have no money.. Good Luck to everybody and Dave this was therapy for me I would go on the site just to be around folks who felt the despair that I was feeling. Never thought I would be collecting. Happens to the best of people. So hang in there and know you are not alone!!! Nobody can understand the feeling of be "laid off" until it happens to them. Not a good feeling.

Hey Everyone, I also wanted to update you to let you know the system does work, just very very slowly.

I finally received after 9 weeks a check for 8 weeks of unemployment. Yesterday I began receiving my weekly unemployment amount.

I had to make several phone calls and leave messages etc, but you have to stay on top of them. If it seems like you have been waiting a long time, go to the office or start calling.

Good luck to everyone. It stinks having to collect, but now I have the opportunity to find a great job and so do you!!

1. do they deduct that amount from your weekly benefits?
2. do i file the hourly rate plus tips weekly?
3. Can they take me off unemployment bc i am working?
4. Is there a max amount of hours i can work or money i can make?

Sorry i am almost wondering if it is better for me to have a part time job and just buckle down for a full time, i do not want to loose my benefits, they are what is allowing me to survive, I am just nervous i may be going over the limitations, if there are any. Any advice would me great.

Will it be based on my full time job? Or the part time job? I also would not want to adversly affect the part time employer by filing. (Her business isn't doing well, and having to pay into unemployment would be very bad financially for her)

I was recently offered a job in detroit, but since i did not want to move there, we worked out a deal where i would do very limited consulting work. i established myself as an LLC and now learn that i am no longer eligible for benefits. Kicker is that I called DUI prior to starting my LLC to find out the impact on any benefits I would receive. At that time, they told me that if I had earnings to report one week, my benefit would be reduced or 0 FOR THAT WEEK. Now they claim that any self-employment equals no benefit.

Just a comment about the Job Search Log...anyone on EB (Extended Benefits) is required to submit a log of 3 searches for each week claimed. I submit this online on the webcert site. I must admit I am about 3 weeks behind in submitting my Logs and have been all along. I have never been contacted. Also, I did a feverish number of job searches when I first became unemployed and did not have to submit a Job Search Log. If you earn more
than 1/3 of your base amount of benefits, they reduce the benefits
dollar for dollar until you reach the point where you have no

Example: base benefit amount is $600.
You do a freelance project for 4 hours at $50/hr. No problem. Report
it and get the full $600 benefit for that week.
You work 8 hours. You bill client $400; report that to DUA; they

I do not know the precise circumstances of the previous commenter but I think actually forming an LLC might indicate you are not actively looking for a job which would disqualify you. There is no need to form an LLC or anything to do freelance 1099 jobs. Just keep records and report your earnings to DUA AND, of course, include it in your Federal income tax filing as self-employment income...

I didn't see an answer to the question Veronica posed on 8/30 and I just got guidance from a live human at DUI so thought I'd post it here.

Unemployment claims depend on work (or lack of same)/earnings/expenses within an individual week. Freelancers only can deduct from earnings any expenses incurred for that project in that week.

So, for instance, I cannot deduct from last week's freelance earnings the cost of the laptop I bought in May to enable me to do freelance work.

I can deduct the part of my monthly broadband and telephone expenses that covered last week, i.e. approx. one-fourth of the monthly bills.

I cannot deduct broadband, telephone and other home office expenses that I've accrued over the months to keep me set up to do this freelance work.

If I had to buy a software program to enable me to do this particular freelance job, I'd be able to count that as an expense against earnings.

I also confirmed, as has been stated already, that you must divulge any earnings in the week in which you did the work, not when you get paid for it.

Finally (I think this also may have been covered already) I was told that in any week where I get enough freelance income so that I'm ineligible to collect any unemployment benefit, I don't need to check in with DUI (TeleCert etc). There will be no problem reopening a claim if they didn't hear from me at all for one or more weeks. When any freelance income drops to the point that I'm eligible for unemployment benefits again, I reopen the claim (with a live human) at the end of that week and file for the benefit the start of the next (the Saturday-Sunday thing Dave described).

Hope that helps. You should verify this info yourself with DUI in case I've misconstrued anything. (DUI should post this info on their website, too.)

I have been laid off since April 2009. I began waitressing part time to help suppliment my unemployment checks. My husband was offered a job out of state, so we moved to pursue his career opportunity. I had to quit my part time job to go with him. Now Mass is denying my unemployment because I voluntarily left my job. I wasn't even making enough for it to affect my unemplyment benefits. I had to leave. How can they do this? My husband and I could not have stayed.

This is telling people not to be proactive and try to find work.

I've been unemployed since Dec 19 08. I've Ive been fortunate to collect this entire time but it since ran out when my balance hit zero. I called last Monday they said to file on Sunday and if still unemployed then on Dec 21 I have to call in and open a new claim.

Up until I was laid off 6 months ago I earned $67k and my partner earned $75k both were laid off!!! Please have some compassion!!! Im a construction worker and I was laid off from my job in March 2009. I was able to open a new claim without any problems and I collected until June 2009 and closed my claim when my former employer re-hired me back. I got laid off again on Friday Novemeber 20th. I went o the local unemployment office on Wednesday (in person better than phone which is too busy) November 25th to reopen my claim. The representative told me that I am all set and that I may do my weekly claim beginning Sunday, Nov. 29th. Comes Sunday, Nov. 29 I log on and complete the 3-4 question claim form and get a memo message on the bottom saying that our records shows you recently reopen your claim and we are reviewing your eligibility and may take 10 days from the day you reopened your claim. My question is, regarding this message and the fact I began my weekly claim, once I am reviewed and in good standing will I be paid up for each week I claim that is due to me? Can anyone tell me what their experience was? It's the first time I had to reopen my claim and Im a bit confused because I was told that I am all set. I dug up unemployment's web site and found no information what shall be expected when one reopens their claim. And thank you in advance to those who response.

I just started a "new" claim two weeks ago, as my 1 year anniversary of unemployment happened on Nov. 24th. I was told that since it is technically a "new" claim, I would have to wait one week before starting to receive benefits again. I think everyone should know that because it is not on the MA site anywhere. Yet it is Tuesday of my second week and STILL no money. I just got a response from DETMA on my claim and while it's not great news, I think it will be helpful info for everyone else. So once you go over the one year mark of unemployment you have to re-file your claim. I did so over the phone and the lady told me that there would be a 1 week lapse in payment because they have to "process" it. I just heard from DETMA that is partially true. It is actually a 3 WEEK lapse in payment before it starts up again. So if anyone is getting to that 1 year point, please make some provisions because you WILL NOT get any payment for up to 3 weeks. I had been on unemployment from 2/08-8/08 and was just laid off again in the beginning of November '09. I filed in person and there didn't seem to be any issue. The woman who entered my information told me to use the pin number I had used before. I can log in online and I see a balance in my account, but it shows my last payment as the last one in August 2008. I got one random electronic payment out of four I should have received by now.

I got my paperwork back and everything still seemed fine, but no payments. I have made 45 unsuccessful calls to unemployment trying to get through. I did receive an email saying I had to answer some questions about my severance last week that was very odd. They asked me questions like how many more people at my company were going to get laid off and how did my company determine the amount of severance I received. This seems like an error to me and these questions should be directed to my former employer.

I have no idea what the hold up is at this point or how to go about getting answers but after this length of time it's getting really stressful.

I have tried calling and putting in a fake ss# just to see if I can get through. It hasn't worked, but the messages I get are different, which makes me think they have tagged my number so they don't have to speak to me.

Is anyone experiencing anything similar?

The state I'm in requires you make 2 job search contacts a week - by telephone with the person with hiring authority, by resume, by fax or by internet email. And the log must include employers, names and titles, phone numbers...etc.
This is the first time I've been unemployed. The work I've done for the past 15 years, since I graduated from college, is highly specialized, big corporation work. And these companies require you apply for jobs on their sites. There is not posting of the hiring managers name or the hr recruiters name...unless they contact you.
How do I log that? When I may not get a call?
And what do I do about a week or 2 weeks when there are no jobs posted in my specialized field?
I'm terrified of loosing my benefits and loosing my house.

Fellow Massholes: Just wanted to give those with their one year unemployment anniversary date coming up know my experience, as it was nerve wracking! I was in the middleish of my 13 wk extension (I got 26wks, then 20, now on 13) on 11/21/09, which was my one year date. Because that date fell on a Saturday, I was able to claim for the week prior without issue. I stupidly assumed that because I was in the middle of an extension, I was all set and my one year date didn't matter, but when I went to file the following Sunday, I was told I had no claim. Scary! So I re-applied for unemployment on 11/30 by phone (call around 4 and enter 1 as the last digit of your social when calling, you may have better luck getting through). I was told there was a one wk waiting period between claims that I wouldn't get paid for, but that I would get my next check the week after that. When that didn't happen, I went to my local Workforce Central office (the people at the Worcester branch are incredibly helpful and kind, in my experience). They told me there is NOT a one wk waiting period for the anniversary/new claim, but that the new claim may take 3 wks to process, because it had to be denied before it could be reverted back to the middle of my 13 wks. This is accurate. Yesterday, 12/15, I received 3 direct deposits, which means I was paid for all weeks--there is no one week gap in payment, but the delay just about broke me, mentally and financially! For me, I went from 11/24 until yesterday with no checks, exactly three weeks, but now I am back on track and my claim shows the remainder of my 13wk extension funds as being available. The cherry on top is that I GOT A JOB OFFER THIS WEEK!!! It's beginning to look a lot like Christmas!!!! Keep trying and good luck, folks!! :-)

I have a question about extended benefits.
I have been collecting for the past 46 weeks (26 weeks from state and 20 weeks of extended benefits). My unemployment account now reads zero so I contacted the unemployment office about the 2nd extension and the rep said just file the like you always do and it will update automatically and there will not be an interruption in payments. Well it turns out that I can only reapply on or after Jan 16th 2010 (the one year anniversary of being laid off) and only if I have worked in the past 15 months.

So a week before Xmas my checks stopped, what happened to the second (13 weeks) extension I thought every one got, never mind the one just signed by the president this past Nov.

I just filed my last week for the benefit year. I looked up the informaiton and it appears yes we do need to refile the claim but that is because you may be intitled to another claim since your benefit year is over (technially) in which you will collect from state money vs federal (eui). Feds are funding the extra money not the state but the feds want to be sure you do not qualify for another claim from state money.
If you do not qualify for another claim you will continue to collect off the federal funds emergency plan until the extra weeks used. It really does not mean squat to us its a matter of getting their papar wor in line.

To the person who suggest we look for a job above what is required. You obviously have not been recently unemployed. Personally I apply for at least 4-6 jobs each day some several times trying to get my resume near the top of the pile,for 1 year. Still nothing. I am licensed in 12 states and held the same position for 17 years prior to this layoff so I am fully qualified in the industry. So just because we dont have a job does not mean we are not looking.

I have been told by a company which I applied to 12 "open" positions, they listed them to create a book of what talent is out there in case they have a need. I have been on a training interview the trainee was the manager I was the unemployed person who bought a new outfit got all dressed up purchased 12.00 in gas and traveled to ten buck two so this manager who was never hiring could be trained. I could give you more but will spare you. But dont think we are not looking.

I am confused over Jimmy and Michelle's experience - why would you have to wait 4 weeks to file for a Tier II extension when it's supposed to happen automatically? I understand having to wait for payments to resume after refiling at your one year anniversary date, but not before that. I am worried as next week is my last week of Tier I, and my one year anniversary isn't until February 3, 2010. I can't wait 6 weeks to get this assistance. Any ideas? Thanks.

During the week claimed, were you able to work and available for work?

I pressed "9" for "No", because there was no job available for me for the week. I wonder if this was a wrong answer.

I then checked my online status. It is:

Call the Telephone Claims Center. Additional information is required to determine your eligibility for benefits.

What's the phone number of "Telephone Claims Center"? What additional information do they need?

I got this question straightened out. They told me that I should get a check in about 4 weeks (if I qualified).

What does this mean? If I get my fist check in 4 weeks, shall I expect a 4 weeks' delay in each payment, or shall I expect that they skip the first 3 weeks of payment?

Also, when I check the status on webcert, it reads:

The following message was provided to you on December 20, 2009. This information may no longer be applicable.
Call the Telephone Claims Center. Additional information is required to determine your eligibility for benefits.

Since I've already got my answers straightened out for the weekly claim, shall I ignore this message?

Tier II is automatic as Jimmy stated. However, I don't know if they had a glitch this week or this is how it works... when I filed on Sunday the system said I had no benefits and my account had $0. However I did get my check direct deposit today(a day late) and got my redetermination letter. So I am all set and I didn't have to call to setup for tier ii.

So I wouldn't worry if this also happens to you on Sunday... the system will update it just may take a few days.

when I first started with unemployement... it did take about 4 weeks before I got any $$. Once you are approved you will get 4 checks or direct deposits all at once and then after that it will be weekly. I don't think they update those messages, mine seem to be the same and only changes when I do the weekly certification. Hope this helps.

I was laid off in November of 2009. I had no problem with the system, I started receiving my checks direct deposit right after the waiting period.

I have been working a few hours as a freelance consultant but the work is usually done on Thursdays and Fridays. The client company had Christmas Eve/Day and New Year's Eve/Day off and a lot of people took vacation so it was decided that we would just regroup on January 4th since so many people were going to be out. I filed those weeks as zero partial income earned and received my full UI benefits. This last week I got a note saying that "there was a break in my partial earnings" and I had to call to reopen my claim.

Called on Monday and told to call back on Thur/Fri/Sat because of the days assigned for social security numbers. Called first thing Thursday and got the high volume of calls call back message.

I am assuming they just want to make sure that I did not quit or get fired from a part time job and want to know what the break in partial earnings was?

I'm still working as freelancer for that client and we hit the ground running this week.

Any thoughts?

Sharing what I found out for others.

In Mass, if you show two weeks of partial earnings followed by two weeks of no earnings, your account is automatically suspended and you have to call.

At first she was going to make me wait while she confirmed with the company that I was still working.

When I explained the dates and that I have a 1099 contract, all of a sudden she said "You have a 1099 IC contract? I am re-opening your claim."

So I just refile on Sunday as normal.

I found that she was very suspicious at first and then as we talked, she got nicer and was very nice at the end. I guess they must get a lot of people who try to get away with stuff so they have to start out that way. A friend who is also on UI had the same impression.

Hopefully when I go in on Sunday, everything will work fine.

The arbitrary nature of this process continues to amaze me. "They" just don't appreciate the fear factor--how one wrong word can end up meaning the difference between whether you kid goes to the doctor or not because some anonymous person on the phone decides you don't deserve to get benefits... I have gone off and on with partial earnings throughout the past year and I've never had a problem. When I reported income that caused me to get $0 benefits and "stop earning," I simply called back the next week and told them I was still unemployed and they re-opened my claim. The magic words, as you discovered, are "1099" or "independent contractor." I don't know how it works if you get a part time W-2 job where you are essentially "under-employed." But if you are freelancing...make sure you say you did some freelance work as an independent contractor last week, but you are still unemployed and looking for work now... I am no longer claiming unemployment. I started a business and while I was honestly looking for work and freelancing last year, I think it is just too gray now to justify opening another claim for the next year. Wish me well! I won't miss the bureacracy.

Does anyone have a sense of average turn around time lately? This week will mark 3 weeks since my filing, and just want to get a sense of when I might expect to hear. I am filing my weekly claims and have verified that my former employer returned the necessary paperwork.

I was laid off on a Wednesday. I filed the next day and completed my online claim that first Sunday, but didn't qualify for benefits that week because A. I had made too much money in those three last days and B. there is a one week waiting period.

I filed my weekly claim the following Sunday and got no money because that was the official one week waiting period. The week before did not count as the waiting period because I did not qualify for benefits due to the three days of earnings.

I filed again on the third Sunday since I was laid off and received my first check two days later.

I would think you would start receiving a check for filing today. If not, call them back.

The first week I was eligible to file an initial claim was the week of December 20th. I did so on Wednesday the 23rd, which was my assigned day to call based on my social security number.

I've filed weekly claims online for the week of the 27th, January 3rd, and January 10th.

I received my initial information packet, but have not heard anything since. My claim is still listed as processing.

I appreciate the advice. If I don't hear anything by tomorrow, or Wednesday-I will give them a call back.

My work is seasonal and every winter i get laid off. Also, every year it takes longer and longer to receive any money from the state.

I was separated from my employer Nov 17...waited until Nov 27 to call...Last Monday, I caled and they gave me the name & number of an adjuster...called Mon, Tue, & Wed and they called Thursday saying my adjuster was someone else. Called new adjuster immediately, and had my interview that afternoon. Called today to check status, a few hours later my alloted funds were reduced by the appropriate amount...hopefully eft or check soon.

I just certified my weekly UI with the DUA today, and I saw on the results page that my claim, which was reopened in 11/09, is set to expire on 2/20/10. It also said that I may need to file anew. I am quite concerned that my weekly UI check will completely stop. Is there anything that I can do now to prevent another waiting period from happening? I really cannot afford any interruptions.

Just a quick update for others who are waiting.

I JUST got my monetary benefit determination letter at the end of last week, which was 3 weeks from the date I filed my initial claim. I was eligible to begin filing, and did so the week of 12/20.

I suspect they may be backed up in processing due to the New Year. I'm heading into my fifth week of claiming benefits without any money as of yet. I'm going to call this week to see if I can get an update.

Husband's co. lost their contract (security co.) - new company did not pick him up. Old co. couldn't guarantee 40.0 week and same rate of pay (worked for them 15 months) and he asked for a new schedule from them, they laughed in his face. He quit and then filed for unemployment on 12/1 approx. Received his packet of benefits, initial determination letter; shows $ in his account on the website - finally got a call from the adjunctitator yesterday-she told him that she had waited 3 weeks for the company to get back to her and had to call them again to hear their side. Called my husband for his side and now told him she will contact company and then make a determination within 10 days. He's been waiting for 7 weeks - does this sound right? Never been on unemployment. thanks for your time.

Hey everyone. I exhausted my initial claim back in June. Managed to find temporary employ and was laid off again. In filing for Tier 1 extended benefits I had a much faster waiting period go by. About a week or so till I got my first check on Tier 1 EB. I encourage you all who are in limbo waiting for your first check to be patient and in the meantime try the UI check status line listed in your unemployment insurance guide that was sent to you. 617-626-6563 this also gives you a seemingly better chance at talking to someone if you have questions. You will still be put on hold after your automated check inquiry but I found the waiting time to be less. Good luck!

I may be getting laid off by my full time employer.. if I do and I get unemployment benefits, I can still be a realtor (independent contractor). When and if I ever have a closing, then I have to report the commission for that week? Then I would become ineligible for benefits for that week and will need to reopen my claim the next week? Is that right?

That is a tough question (part time Realtor job). I believe that as long as your realtor business is not "interfering" with your job search, you can continue to claim unemployment benefits. See this FAQ on the DUA website about starting a business while unemployed. I have no idea how you'd report the income for a house sale. I would think your approach the only practical one since you cannot assign an "hourly" rate to the things you do with a home seller.

Great idea, great site! I have received more info here in minutes than all the hours on hold with MA. Work Force Developement. I am a construction supervisor receiving the full $628 weekly benefit. I was laid off in Feb. 09. I have gone through my intial 26 weeks and my 20 week EB. I am now just starting to receive the 13 additional weeks that will put me into mid april. If I apply for career training before my one year aniversary in Feb. I will be intitled to 24 additional weeks of benifits. My question is, what will happen to the 10 weeks of the 13 that I did not use? I understand that if you qualify, there is up to 79 weeks of benifits. Is the 24 weeks for retraining part of that 79 weeks?

Does anybody know if the income you received from a part time job will affect your benefit amount if your initial claim expired and you have to refile? One DETMA employee told me if you make more than $3,800 they'll redetermine your benefit amount. I was told by multiple people when I first filed last January that you can make up to a third of your benefit without it affecting your benefit. I am SCREWED if they base this refiled claim on just my part time job earnings. However, I don't know if this is actually correct, and I get a different answer from every person I try to get clarification from. Thanks in advance.

Dave - this is a great site and I've also learned a lot. My former employer shut down the company as of December 31, 2009. I receive the full benefit and am getting my amounts regularly now. The issue is my former employer did not give normal severance package upon the date I and others were let go. He is giving myself and others a severance check which will arrive this week as a live check and paid through a 1099. We all filled out a form last month. This will of course not be reported to the Feds until the end of the year. The third question "Durinig the wek claimed, did you work or earn holiday pay?" is still literally speaking a NO. How should we go about reporting this? Wait until the end of year taxes or somehow report it. Will unemployment see it as just a week of pay (it is equal to one month of pay in actuality). Nobody seems to have a definite answer. Normally is severance looked at as in this case 4 weeks pay and your unemployment is held off by that amount. Any help or answers would be appreciated. Remember, this is not a payroll check and has no taxes taken out. Again great job.

Dave in Milton - r. you severance check. All you can get here is hearsay and random opinions. So for total comfort you'll want to call and ask. That said, I'd say it's obvious that you didn't work and the check is compensation for work you did in the past.

Pam - That all sounds typical to me. But note, "quit" is not a good word to use in unemployment office.

I am in the same boat that you are in. Unfortunately, there is not much one can do when the benefit year expires other than file anew, and wait the 3-5 weeks that I was told by the UI office in Quincy. I suggest working with your creditors like I am doing and really tell them what is happening and the DUA's time period for making a decision and sending you your checks are completely out of your control. Sorry to suggest IOUs, but the state truly does not care about your bills unless they are elected officials who want your vote on Election Day. Also, visit your local UI office every other week for status updates and offer to do anything that you can to help expedite the process. Good Luck.

I have a question about returning to work for a short time. Company A laid me off in November and gave me a 1099 contract a week later for 1-4 hours week. While I look for full time work, I just landed another 1099 opportunity today with Company B. Right after that my old boss from company A called me and said he needs me back for 3-4 months, as a 32 hour a week employee with full benefits and I can still work my freelance jobs and he wouldn't hold that against me even if it ate into a few of his 32 hours.

My question is, if he lays me off again in 3-4 months and I file for a new unemployment claim, will unemployment hold the other 1099 contract with Company B against me and not let me collect again?

I've left a message with my accountant to ask the same question but it is tax season so it may be a few days before I hear back. I guess if unemployment will hold Company B 1099 against me if I get laid off again in 3 months, then I will just have to stay 1099 with Company A and suspend my current claim for three months. (The one problem is that I have to travel for company A and they will pay me mileage but not for my time on the road which would be 3-4 hours a day.)

I still intend to keep looking for a new job in the middle of all of this!

2 weeks ago I received direct deposit of my UI check for the 14th week of a 20 week extension. This was the extension voted on by Congress last November.

Though I have been certifying weekly, I have not received any more checks.When I certify, the message comes up that I have exhausted my benefits, but this has been coming up ever since I started my new extension.

Has anyone else had such an interruption or cessation of payment without notification?

As you know, it is impossible to speak to a human on the phone regarding UI.
