DO NOT PURCHASE ANY HEALTH INSURANCE THAT FAILS TO MEET MASSACHUSETTS MINIMUM CREDITABLE STANDARDS. The policy I described in this post originally, is not a valid policy and should not be allowed to be sold in Massachusetts. Through a legal loophole, it is technically legal to purchase, but if you purchase such a policy, the state will fine you up to $1000. If you must purchase private health insurance, go to the Massachusetts Health Connector website for more information and ensure that the policy you purchase meets those minimum standards as described in my more recent posts linked above.

Rachel Levy and I have both been blogging about our searches for work. If you know anyone looking for a marketing professional, please go visit her site and hire her. My blog is not only about looking for work--check out the archive to see the breadth of things I've covered in the past two years...but today, I want to talk unemployment.
The Massachusetts Division of Unemployment Assistance website has a great deal of information, but there is very little to answer the specific questions real job seekers have and no way to actually do anything of value there. Once you have filed your initial claim, you will be able to go online to file your weekly claim. But in the beginning, there are so many simple, basic things they do not tell you. So I'm going to list what I've learned here and invite people to comment and fill in the details...
Top 7 Tips for the Unemployed in Massachusetts
My purpose here is not to tell you how to find a job. It's just about the hoops you need to jump through to get the insurance benefits you are entitled to receive while you are looking for work. I recommend you just do these things and don't get hung up on lots of questions or debates about why the system is the way it is. We have a pretty good deal in Massachusetts compared to other states, so check your attitude at the door and don't let the bureaucracy and cesspool of negativity you may encounter distract you from finding a job.
Follow up:
1. Go stand in line. Or, more accurately, sit in your car holding a number. Do not bother with the phone; it is busy. There is no way to register online and no forms to print out. So rather than call and wait on hold for hours, what you should do it go down to your local "walk in center" in the middle of the day and ask them when the line forms, then come back the next day at 7am or so to get a number. Then go get a coffee from Dunkin Donuts and come back at the right time. Make sure you bring all the information you will need to fill out the form. When I filed my claim, the center was experimenting with a group filing approach; we all filled out our forms together and I was out of the building within half an hour. Then, later that day, I received a call from the intake person to confirm he had registered me in the system. Easy. Painless. No frustration.
It would be nice if the form were online so I could fill it out in advance, submit it online, or even just mail it in. It seems ridiculous to have to stand in line to get a form that you fill out and hand to a person, then leave.
2. File your Medical Security Program application ASAP. If you are receiving unemployment benefits, you may be eligible to participate in the Medical Security Program. Download the application form, fill it out, and send it in before you file your initial claim. If you are eligible, MSP will reimburse you 80% of your COBRA premium up to a monthly maximum of $1080 for a family plan or $440 for an individual plan. My COBRA plan would cost me $1312.92 per month for Blue Cross HMO Blue Enhanced Value.
Are you eligible? Probably, especially if you have kids. But the determination of eligibility is complicated so rather than try to figure it out, just get the application completed and filed ASAP along with any required supporting materials...like the letter you need your wife to write saying she is a stay at home mom.
Download the brochure and application form and read them carefully. The website itself does not give the details you need. But get the application in so have it ready if you need it. If you fail to submit the application right away and find you need health care, the state will not pay retroactively; a friend I know is already in for $2600+ with the state refusing to reimburse the COBRA payments he made before his application was processed. You can file an appeal--another great use of your time when you could be looking for a job.
3. Wait for your first unemployment check to arrive before you try to call MSP. I burned through 45 minutes of cell phone time (I do not have a land line) before I got to a person who said she could not help me until I had received my first check. It will probably be a month before you get a check and maybe 6 weeks before you learn anything about MSP. In the meantime, you will be hoping you don't get sick, avoiding going to the doctor, and not electing to use your COBRA "benefits." You have 2 months from the date you are laid off to elect COBRA and it can be retroactive. So, if you have an emergency, you go to the doctor then pay COBRA.
If you do qualify for MSP, you will have to front the money for COBRA premiums and get reimbursed. And I do not know how part time work affects your eligibility for participation in MSP, but I suspect it is not good.

4. The Commonwealth Care program is irrelevant to you. If you are eligible for MSP + COBRA, you are not eligible for Commonwealth Care. You can use the Commonwealth Connector web site to shop for private insurance, but you will not get the low-cost or free health care that is available for people who did not just lose their jobs. It is interesting to note that this site shows me many options cheaper than COBRA, but none as good as the NASE plan.
5. If you find part-time or consulting work...manage your time strategically. It is a crime to fail to report that you worked and earned money while unemployed, and you are allowed a pittance of earning (1/3 of your benefit amount, e.g. a couple hundred bucks), but what typically happens is if you make any significant money, you lose your benefit for that week. So if you do manage to find some freelance work, make sure you do it all in one week. Don't do something foolish like work 10 hours a week for 4 weeks. Schedule your work so that if you have a 40-hour project, you can do it all in one week.
6. Stay positive. It is easy to get upset when you are on hold forever and then the phone hangs up on you or the person who answers refuses to help you. It is frustrating to click on website links that claim to give you information on how to apply...but then don't link to the forms. And it is terribly frustrating to listen to repeated hold messages telling you to go to the website...when the website is telling you that you have to call the phone number. But just do what you need to do and get back on track looking for a job!
7. Don't feel like a scumbag. I try to laugh at the movie Office Space and recall the line from one worker who is afraid of being laid off:
I'm going to be the first one they're gonna lay off. Just the thought of having to go to the State Unemployment Office and having to stand in line with those scumbags!!!
There is no shame in collecting unemployment. We've been paying into the system for years--or at least our employers have been paying for us. It is social insurance, designed to cover just this situation. It's not a government handout.
In the 1930s, perhaps our grandparents gave up their dreams to provide for their families during the Great Depression...they put their college degrees away and found jobs doing laundry or whatever it took to keep their families fed. There was no safety net and dreams were deferred out of necessity. But that generation enacted social protections to help prevent that kind of thing from happening again. For a few minutes, the lucky among us who had good jobs, stand in line with the laborers and attorneys, ironworkers and accountants, in these challenging times, and focus on building a better future with a least a few months protection from losing our homes and freezing in the cold because we were only a paycheck away from disaster. If there are some hoops we must navigate, we do it, and we move on.

I work for the Commonwealth Connector Authority and just wanted you to know that you understandably confused the Health Connector with one of our two core products, "Commonwealth Care." "Commonwealth Care" provides subsidized health insurance for those who earn below a specific level of income.
We have another product, "Commonwealth Choice," which provides unsubsidized health insurance coverage and for which is increasingly popular as an alternative for those looking for an a more affordable option for COBRA coverage.

We filed the MSP paperwork the day after my husband was laid off. Because of the long wait currently for the first unemployment check to arrive, I'm not sure it's the best thing to wait to apply. We got accepted a couple of weeks after the first check arrived (which was about 5 weeks from the last day of work.) Also, it should be noted that according to one of the MSP telephone agents, you WILL be accepted to the MSP if you meet the qualifications.
The wait right now on the phone line is crazy. But we have been able to get through twice. We called late in the day and right BEFORE lunch with decent luck. We still had to wait a long time - not advised, of course, if you need to manage your minutes. :)
Another big misconception is that you cannot file an unemployment claim if you were given a severance. Not so! If you had to sign a general release, which you probably did, you can file the claim right away. This is key when you may be off work for awhile like in this craptacular job market.
My tips: If you actually want to find a job, do more than the legally required minimum weekly job search. Do a LOT more. Looking for work is just about a full-time job. And don't get discouraged -- it takes time to find a job, and even more time to find one that's right for you.
There are two MSP options: premium assistance and direct coverage.
You wrote about COBRA reimbursement which is the first option. But, even if your previous employer offers COBRA, if you can prove that the cost (before reimbursement) is too pricey for your monthly expenses and cost of living, then you may be eligible for the second option.
That's what I'm on. When I was laid off last year, the COBRA choice was over $400 a month which I could not afford. I mailed-in the requisite paperwork and showed my monthly expenses. The state approved my waiver and signed me up for direct coverage through Blue Cross Blue Shield's Network Blue Preferences plan.
In other words, while the premium assistance plan covers up to 80% of COBRA, I'm paying diddly squat a month for a no-frills basic health insurance plan that only costs me money if I visit a doctor or need drugs.
It's not an option for everyone, as you need to meet certain guidelines of the federal poverty level... but that, too, can be waived with the right paperwork.
I've figured out most parts of the unemployed life, but trying to figure out how to get health insurance has me feeling overwhelmed to say the very least.
If you get laid off on monday, the first of the month and file the same day at the walk in office, when do you start getting paid?
For instance, does the week I got laid off on count as my waiting period if they paid me for that day... 200.00?
If not, does that mean the week I got laid off on doesnt count and the following week would be the waiting period, so the third week of the month would be the first to count and could expect a check for it on the fourth week?

I am completely depressed and desperate for answers. I have called, stood in line, called again, and stood in line some more. "Your claim is still processing" is the ONLY thing they will tell me. And I mean the ONLY thing they will tell me. The case workers have actually told me to go home and be patient. I have spoken with my previous employer and they filled out all the paperwork correctly and did not contest anything. I even took the papers to the post office myself and mailed them 2 1/2 months ago to be sure.
I do feel exactly like the scumbag from Office Space. It feels like I'm being singled out somehow. I'm looking for IT/Network jobs diligently while also trying to take care of my son during the day (we've had to remove him from daycare), and have no idea how much longer I can keep this up without pay.
Please, anyone - can you offer any answers.....? Thank you so much to anyone who can help.
I wanted to thank you very much for the responses. If you can believe it, I finally got a call yesterday from a case worker from Springfield who needed clarification on my case. What had ended up happening is that they never got the paperwork, or that it is in a pile somewhere and it hasn't been processed yet. The woman I spoke with was incredibly kind and caring and she manually approved and released funds at the time of the call. She even apologized for the extended delay and worry it caused, but I know it couldn't have been her fault. The timing ended up being more than perfect, and our landlord is very happy. I did contact Transitional Assistance and they did offer great information and contacts.
This blog helped reassure me that the system does work, so I wanted to thank Dave personally for writing it. Luckily, my wife still has medical insurance through her job, so we have always been ok there.
Thanks again, and let me know if there's any way I can help or give details about my experience. Whoa, now I can finally breathe a bit easier. The great news is that I had a very promising interview also yesterday, and I'm positive for our future.
Thank you to everyone who read my post and reached out. This is the type of togetherness we all need in these troubled times. And yes, I would have had no problems accepting the food stamps, as I'm willing to do whatever it takes to provide for my family. I can only imagine that no one in the Quincy office suggested these programs because they too have been so overwhelmed with applicants. It's just hard to stay positive when you feel like there is no help. Now I'm convinced that together we can get through this!
I have the opportunity to take on freelance work but I am uncertain if I will be able to continue receiving benefits after I complete the contract work. I understand that if I report my wages I will not receive benefits for that week. My concern is that if I take on a larger job, making well over my benefits say $1000/wk for 4 weeks, can I still collect benefits after this job is complete or will I be considered self-employed if I earn too much in a short period?
I want to take on the work but I don't want to risk losing my benefits entirely. any help is appreciated.

I know you have covered this subject a lot Dave but just wanted to verify that if I take a week long freelance gig report the wages earned I will have to RE-FILE the following week for benefits? I can't just do the weekly online or on the phone claim Sunday the next week when I do not work and say I did not work and begin picking up my unemployment again I have to actually refile? Sorry just trying to verify?? Great info though!
for example, here is what I did:
week1: $0 earned, go to web page on Sunday and report that, get direct deposit on Tuesday.
week2: $2000 earned through freelance gig., go to website on Sunday and report. no benefit that week and benefits "cancelled"
week3: $225 earned, call phone number on Saturday; tell them you need to reopen claim. They take down information and say, "ok, you are eligible again, call back tomorrow." Sunday, go to website and fill out form reporting $225. Benefit is reduced because, apparently, the 1/3 amount allowed is based on your base benefit, not allowing for dependents. Direct deposit of reduced benefit on Tuesday.
week 4: $187.50 earned, go to web on Sunday, report, full direct deposit on Tuesday.
1. I might be getting a part-time job - so as long as I don't go over 1/3 my unemployment pay a week - my claim won't be cancelled and I can file regularly on Sunday?
2. I'm confused about COBRA. My COBRA paperwork is in the mail and I want to apply for the MSP...how does that work? I pay for COBRA and if I am accepted into the program, MSP will reimburse 80% of my COBRA premium for that month? Why does it matter if you go to the doctor? Isn't COBRA retroactive to the beginning of the month that you are paying for? I understand that the MSP won't reimburse you for COBRA payments already made before acceptance, but why are you out money if you use your COBRA benefits before acceptance into the MSP?
3. What about the stimulus - isn't the government subsidizing 65% of COBRA premiums for people laid off between 9/1/08 and 12/31/09?
I was temporarily laid off at the end of January for one month. I applied for and received unemployment benefits for the last 3 weeks of February.
I returned to work this week for 1 day, and was then permanently laid off.
Do I just report the 1 day's wages this Sunday (slightly over the 1/3 limit) and receive the reduced benefit amount then just continue filing each week...or do I need to contact unemployment and somehow close/reopen the claim as a permanent layoff?
This was covered above, but only on a one week basis. Anyway, I have been collectine unemployment for a couple of months. I have an opportunity to work a contractor gig for 2 months or so. However, that will be the end of it for sure. Can I reopen the claim after that long? I have heard that once youopen the claim, it can be closed/reopened again for the duration set by the unemployment rules -- I think it is 30 weeks, plus an extension of 20 weeks or so. I just want to know if taking this short contracting job for 2 months will close my claim forever.

The problem is just that it is extremely difficult to get through to a person if you have a situation that cannot be handled in an automatic fashion.
If the internet is giving you trouble, you can always call Telecert. The number is 1-617-626-6338, you need to have your social and pin in order to claim the previous week. You can do it sunday through friday 7:00am - 7:00pm. You must stay on the line until you hear "your weekly claim filing is now complete." Hope this helps.
Thanks for taking the initiative and offering this important information. Like Jon who posted on 3/9, I have been unemployed since November. Recently I was offered a consulting gig that will last for 2 months. I am concerned about taking it because once it is over there is a very good chance that I will not have another assignment lined up. Furthermore--this assignment is part compensation and part commission (I will not know how much commission for months)---My question--can I take the 2 month gig and then reopen my claim? Thanks in advance.
Just an FYI, UI is currently backlogged 4 to 6 weeks, and you are posting a 10day wait period for your check. I also have filed 2/26, gone to the office, and called, with 2 children it is getting tough. TA is also backlogged, and currently there is no "Emergency Status" I got harassed about My son in college not working, so he is ineligible,and my ex-husbands income (he has been out of work since 11/08)
All my worker could say was, I am sorry you will just have to wait, we are very behind

i am glad they fixed the wait, but what about us that have been waiting for almost 3 months. Ive been waiting for someone to call me back for 2 weeks, i don't know how many people i can call or leave messages for to get my check processed.
I received UI benefits in MASS for the better part of 2008. I was laid off in Jan '08. In addition to working at my full time job (which I received UI after losing) I am a musician. I've had songs placed in tv/films throughout the years and receive quarterly royalty checks in '08. These amounts vary but usually it's about $700 to $1,000 every four months. In filing my taxes this year I'm looking at the 1099 my publishing company sent me (total: $4,000) and I'm wondering if I should have declared this when I called in my weekly UI for weeks I received my royalty check; one week in Jan '08, one week in April'08, one week in July '08 and October '08. I didn't actually work - and these are royalties earned from '07 for the most part. I'm very concerned about this. I've searched on line but I cannot find a similar situation. Any advise would be greatly appreciated. I hope this makes sense.

I've been on unemployment insurance since last year, haven't found a job. I keep the mandatory work search log each week, but I'm trying to understand exactly how it works. From what I understand, I need to provide the work search log "upon request." So, it sounds like you only need to give them the work search log if they ask for it - sortof like the equivalent of getting audited by the IRS for your taxes.
Anyways, I just feel a bit paranoid about this. Has anyone here ever been asked to submit their work search log? Do they ask for a portion of your work search log, or the entire thing?

If you know of a person who is collecting money "under the table" or is not really looking for a job, you can report them to the DUA. In the case of someone collecting money but not reporting it, I'm sure the IRS would also be interested.
I just applied for UI benefits, and am actively looking for an "Outside Sales" job in Massachusetts.
Dave, what happens if I'm getting UI benefits, and then I find a FULL TIME 100% COMMISSION position, but do NOT make any money in my first three to five weeks? Will I lose ALL of my UI benefits anyway, just because I worked over a certain amount of hours...even WITHOUT having received any money from the job)?
I asked the lady at the UI office in Massachusetts, and she said that I MUST report that I am working (even if I'm not getting paid), which is fine. But THEN she said, that I will NOT receive benefits if I'm working over a certain amount of hours (even WITHOUT getting a paycheck)!!!!!!

That's not fair. Why? Because, while trying to get my feet on the ground in a 100% sales/commission job, I would have to go WITHOUT money until I get my first check from the sales job!!! That could literally be WEEKS and WEEKS while I'm in training, learning, etc...!
Dave, and everyone, please respond to this, because I'm really confused! Is this accurate? Is it REALLY TRUE that if I accept a full-time 100% straight commission job, I will NOT get UI benefits (even if I'm NOT making any money yet)?

Using other job search activities such as reviewing job listings on the internet, newspapers or professional journals, contacting professional associations, networking with colleagues or friends.And here is one I didn't think of:
Reporting to the Union Hall, if this is your primary worksearch method.

I missed it last week and didn't do it. Has anyone had any experience with the Work Log from the State?
I was able to submit my Sunday filing without doing the Work Search part.

I filed my initial unemployment claim on June 7th. It's July 4th and I have not received payment. When I log on to check the status, it tells me how much I have in my account but I have not received a check.
I have a freelance job. I worked one day yesterday (Friday) which I will report tomorrow (Sunday). I will be working this freelance job this coming Mon-Fri and I will report this on Sunday. I will be back to making no money the following week so I will re-open my claim that week. (I will make half of my apparent weekly UI wage on that one day on Friday and I will make more than my UI apparent weekly wage in that full week I work)
So..my question is...when I report my wages earned and then re-open my claim...is this going to slow things down even futher? When will I ever get paid????
Do you file every Sunday as directed? You should see during this time the ability to check the status of your weekly claim. If you did not make more than 1/3 of your benefit you should be issued a check. Please check the status page and if needed you might have to call or go to the nearest office in the AM to find out the issue. Hope this helps.
I have a question - does anyone know what happens if you click "no" for the first 2 questions when asked if you looked for work and were able to work?
Due to a hospitalization last week, I was technically not able to work. I don't want to be fraudlant and claim I was. If I click "no" do I get disqualified from my benefits and have to re-submit my claim?
DTA does, in fact, have emergency expedited Food Stamp benefits. If eligible, you receive them within 7 days of inital claim.
What has changed, is if you file for emergency Food Stamps, you need to re-file within 30 days for the benefits to continue for 6 months. This information was told to me directly by two different DTA case managers while applying at the beginning of last week. I received my first installment by the end of the week.

Just curious. I filed on 6/5 and have not received anything although I have received my vacation pay (reported it) and think that is why my file is so delayed.

I called UI this morning and the woman that I dealt with was able to provide me my auditor's name (She also said my auditor called on July 8th but I did not receive any calls) but could not locate her number. However she was able to transfer me to my auditor's extension (??). I left a message with my auditor.
I know the auditor is probably swamped but I'm in full panic mode here because I am reaching week 9 of unemployment and the money I do have is running out.
It's frustrating that in order to reach my auditor, I have to call the UI claim line on my designated SS day and wait just to be transferred.
Can anyone give me some tips?
Last week (mid July) I spoke with an auditor who told me that they are so far behind, that she will be calling me around the first week of August. Because I was FIRED, it will take longer, she said.
Is this true?
I filed on 6/17 and am still waiting to hear from an auditor. I was told 8 weeks. Not sure how they expect someone to survive for 8 weeks while they take their time calling. Granted, I left my job, but I was almost writing them a check monthly to work for them it was so bad.
Hope you all have better luck than I am having. Very discouraged!! Never collected in my life and I have been working for 29 years....pitiful!!
I actually went to the ue office and when I got there they said that I still had to wait another week or two. She said that it was because of something that my employer said. The ue administrator made me feel awful for asking where my first check was after 6 weeks. She matter-of-factly stated that I still had another week or two before someone would contact me. It seems so long and I wish that I truly could understand the process. Why do some folks receive a check almost right away while some wait. I have worked diligently for 20 some odd years and have NEVER received a check before and had to wait 8 weeks....uuuggghhh...
I did quit my job. but clearly there was a problem since I had been there for so long. Just ask the questions and let me know.
When I finally receive my first check will it be for all of the missing weeks or will it be for only one week?
I just can get any questions even though I actually went to the office. they would give me NO information. I have tried to call and get NO person on the other end. I find this extremely frustrating and maybe they are looking for a good person to streamline the process. UUUUGGGGHHHH....
The only good/bad thing is I did find a job that I will start on 8/10 which is good, but I would make quite a bit more if I just collected unemployment. I have no choice because I NEED to get some money coming in and have no idea when or if I will get a UI check.
I heard that once you accept a full time job your UI stops. Pretty sad that I would get 1/2 of my weekly wage on UI and by working I will get 1/4 of my weekly wage. I can't survive on that and have no idea what I will do.

i was laid off on june 3rd and filed on june 5th. was told that someone would call me personally within 4 weeks to go over it all or whatever and that i would then start receiving checks and get back pay for that 4 week period.
well i filled out my weekly claim online every week and watched the weeks tick bye. 4 weeks...5 weeks...6 weeks...7 weeks.
now at this point im worried that i missed a call or didnt fill out a form that i needed or something. any calls to the telecenter got closed by the "sorry but we are experiencing a large call volume please try again later" message.
so completely stressed out and confused i waited in line for the UE office to open yesterday. i was not the first few in line so they put me on the list and told me to come back in 2 hours at 10:30am. once i came back they game me a number and told me to wait. once my turn came i spoke with the woman and told her that i had filed about 8 weeks ago and never got my "4 week" call. she pulled up my page on her computer and said that it appeared that i should have been receiving checks according to her records. when i informed her that this was not the case went to ask her supervisor. as it turns out my claim had been approved just a day prior to my showing up at the office. and my check along with 6 back week checks had been deposited into my bank account. had i checked my bank acct that morning i would have seen it but what are the odds of that.
in any case im all set now. im getting weekly checks deposited to my bank and i got all my back pay weeks. it is surprising that it just got approved without the call to me that they said i was gonna get. i guess they are just backed up enough that if they paperwork checks out (when they finally get to it in 7 weeks) that they sometimes dont bother calling.
so anyone in my situation who is wondering what the hell is going on like i was. hope this story helps.
Just to update everyone, I am now in my 8th week of unemployment. I called to speak with my adjuster last Thursday and did not receive a phone call. I called again today and she had a message on her phone that she is on vacation until next week...UGH
I called the alternate adjuster she left on her voice mail and left a pretty scathing message as to how long are we supposed to wait. I would like to take my son to get school clothes etc but can't afford food or rent while I am waiting on them.
Needless to say I received a phone call within about a half hour from another adjuster. She took all my info...let me know she was calling my former employer and I should not have any problem receiving UI as I had a valid reason for quitting my job.
I am hoping to get my 7 weeks of back pay by next week and can pay my bills, pay all the friends back that I have had to borrow money from for the last 8 weeks, and pay my rent!!
I am starting a job on 8/10 which will pay me significantly less than I would receive on unemployment, but I need money coming in NOW, not whenever.

I did receive a letter telling me the total benefit credit and weekly pay rate.
I have no idea if that means I have been approved and can expect a direct deposit check in a few weeks.
It really is a great help to know it isn't that I have made an error or something.

I was laid off on June 23 and filed on June 25th. I have not received a check yet. I managed to get through only once, to find out that a former employer responded that I still worked for them ( likely a secretary in another building that did not know me. I haven't worked there in over a year. I have not received a phone call and feel helpless. Has anyone had a similar experience?

I was finally contacted 8-10-09 there was an "issue" I'm trying to iron out. "Early retirement" (forced) vs Laid Off. I did find this email but can't vouch that it is what got me a call back.

The system seems to be swamped but does work, My last date of employment was June 30, 2009 I applied the next week.
I finally received after 9 weeks a check for 8 weeks of unemployment. Yesterday I began receiving my weekly unemployment amount.
I had to make several phone calls and leave messages etc, but you have to stay on top of them. If it seems like you have been waiting a long time, go to the office or start calling.
Good luck to everyone. It stinks having to collect, but now I have the opportunity to find a great job and so do you!!
i have a couple f questions i am hoping to get answered. I live in VA now but used to live in MA, i file through MA, i am currently working as a waitress part time in VA until i can fid steady work. When the telecenter asks you how much earned income you made
1. do they deduct that amount from your weekly benefits?
2. do i file the hourly rate plus tips weekly?
3. Can they take me off unemployment bc i am working?
4. Is there a max amount of hours i can work or money i can make?
Sorry i am almost wondering if it is better for me to have a part time job and just buckle down for a full time, i do not want to loose my benefits, they are what is allowing me to survive, I am just nervous i may be going over the limitations, if there are any. Any advice would me great.

I have a random question that I have yet to find the answer to. I was "let go" from my full time job recently and was denied unemployment. I got a part time job for 3 weeks and was laid off from there due to lack of work. Can I collect now?? What will my base pay be??
Will it be based on my full time job? Or the part time job? I also would not want to adversly affect the part time employer by filing. (Her business isn't doing well, and having to pay into unemployment would be very bad financially for her)
So, the question is, if I consult for 6 weeks, and honestly answer the questions of the DUA, can I go back on unemployment after that time?

You do a freelance project for 4 hours at $50/hr. No problem. Report

You work 8 hours. You bill client $400; report that to DUA; they
reduce your benefit for that week to $400.
You work 16 hours. Bill client $800. zero UI for that week AND you
have to call back to re-open your claim next week.

I do not know the precise circumstances of the previous commenter but I think actually forming an LLC might indicate you are not actively looking for a job which would disqualify you. There is no need to form an LLC or anything to do freelance 1099 jobs. Just keep records and report your earnings to DUA AND, of course, include it in your Federal income tax filing as self-employment income...
I didn't see an answer to the question Veronica posed on 8/30 and I just got guidance from a live human at DUI so thought I'd post it here.
Unemployment claims depend on work (or lack of same)/earnings/expenses within an individual week. Freelancers only can deduct from earnings any expenses incurred for that project in that week.
So, for instance, I cannot deduct from last week's freelance earnings the cost of the laptop I bought in May to enable me to do freelance work.
I can deduct the part of my monthly broadband and telephone expenses that covered last week, i.e. approx. one-fourth of the monthly bills.
I cannot deduct broadband, telephone and other home office expenses that I've accrued over the months to keep me set up to do this freelance work.
If I had to buy a software program to enable me to do this particular freelance job, I'd be able to count that as an expense against earnings.
I also confirmed, as has been stated already, that you must divulge any earnings in the week in which you did the work, not when you get paid for it.
Finally (I think this also may have been covered already) I was told that in any week where I get enough freelance income so that I'm ineligible to collect any unemployment benefit, I don't need to check in with DUI (TeleCert etc). There will be no problem reopening a claim if they didn't hear from me at all for one or more weeks. When any freelance income drops to the point that I'm eligible for unemployment benefits again, I reopen the claim (with a live human) at the end of that week and file for the benefit the start of the next (the Saturday-Sunday thing Dave described).

I have been laid off since April 2009. I began waitressing part time to help suppliment my unemployment checks. My husband was offered a job out of state, so we moved to pursue his career opportunity. I had to quit my part time job to go with him. Now Mass is denying my unemployment because I voluntarily left my job. I wasn't even making enough for it to affect my unemplyment benefits. I had to leave. How can they do this? My husband and I could not have stayed.
This is telling people not to be proactive and try to find work.
I filed my claim online Sunday but it still says they are processing my claim and if they need any info they'll contact me. Any idea of I'll see money tomorrow? I have a child, pregnant and have rent due soon.
My question is- when you find out your benefit amount, do you also find out how many total weeks you are covered for?
I just started a "new" claim two weeks ago, as my 1 year anniversary of unemployment happened on Nov. 24th. I was told that since it is technically a "new" claim, I would have to wait one week before starting to receive benefits again. I think everyone should know that because it is not on the MA site anywhere. Yet it is Tuesday of my second week and STILL no money. It took 2 and half months to get money last year, so are we all going to go through this again?
I got my paperwork back and everything still seemed fine, but no payments. I have made 45 unsuccessful calls to unemployment trying to get through. I did receive an email saying I had to answer some questions about my severance last week that was very odd. They asked me questions like how many more people at my company were going to get laid off and how did my company determine the amount of severance I received. This seems like an error to me and these questions should be directed to my former employer.
I have no idea what the hold up is at this point or how to go about getting answers but after this length of time it's getting really stressful.
I have tried calling and putting in a fake ss# just to see if I can get through. It hasn't worked, but the messages I get are different, which makes me think they have tagged my number so they don't have to speak to me.
Is anyone experiencing anything similar?

This is the first time I've been unemployed. The work I've done for the past 15 years, since I graduated from college, is highly specialized, big corporation work. And these companies require you apply for jobs on their sites. There is not posting of the hiring managers name or the hr recruiters name...unless they contact you.
How do I log that? When I may not get a call?
And what do I do about a week or 2 weeks when there are no jobs posted in my specialized field?
I'm terrified of loosing my benefits and loosing my house.

I have been collecting for the past 46 weeks (26 weeks from state and 20 weeks of extended benefits). My unemployment account now reads zero so I contacted the unemployment office about the 2nd extension and the rep said just file the like you always do and it will update automatically and there will not be an interruption in payments. Well it turns out that I can only reapply on or after Jan 16th 2010 (the one year anniversary of being laid off) and only if I have worked in the past 15 months.
So a week before Xmas my checks stopped, what happened to the second (13 weeks) extension I thought every one got, never mind the one just signed by the president this past Nov.

If you do not qualify for another claim you will continue to collect off the federal funds emergency plan until the extra weeks used. It really does not mean squat to us its a matter of getting their papar wor in line.
To the person who suggest we look for a job above what is required. You obviously have not been recently unemployed. Personally I apply for at least 4-6 jobs each day some several times trying to get my resume near the top of the pile,for 1 year. Still nothing. I am licensed in 12 states and held the same position for 17 years prior to this layoff so I am fully qualified in the industry. So just because we dont have a job does not mean we are not looking.
I have been told by a company which I applied to 12 "open" positions, they listed them to create a book of what talent is out there in case they have a need. I have been on a training interview the trainee was the manager I was the unemployed person who bought a new outfit got all dressed up purchased 12.00 in gas and traveled to ten buck two so this manager who was never hiring could be trained. I could give you more but will spare you. But dont think we are not looking.

I pressed "9" for "No", because there was no job available for me for the week. I wonder if this was a wrong answer.
I then checked my online status. It is:

What's the phone number of "Telephone Claims Center"? What additional information do they need?
that question refers to your physical ability to work and if you have available time to work.
Your not on vacation or sick right?
Then answer 1 for "Yes".

I just got off the phone with a Rep from the unemployment office and she informed me that my account will in fact update automatically either Wednesday or Thursday.

I got this question straightened out. They told me that I should get a check in about 4 weeks (if I qualified).
What does this mean? If I get my fist check in 4 weeks, shall I expect a 4 weeks' delay in each payment, or shall I expect that they skip the first 3 weeks of payment?
Also, when I check the status on webcert, it reads:

You should get a check for EUC Tier II in about 4 weeks? Please someone help me out here as I continue to be more confused. This is my last week of Tier I EUC and was told in August that the Tier II of EUC (13 weeks) updated automatically - is this not the case?

I don't know if Tier II of EUC is automatically updated or not. As a matter of fact, I don't even know what EUC Tier II is.
Tier II is automatic as Jimmy stated. However, I don't know if they had a glitch this week or this is how it works... when I filed on Sunday the system said I had no benefits and my account had $0. However I did get my check direct deposit today(a day late) and got my redetermination letter. So I am all set and I didn't have to call to setup for tier ii.
So I wouldn't worry if this also happens to you on Sunday... the system will update it just may take a few days.
when I first started with unemployement... it did take about 4 weeks before I got any $$. Once you are approved you will get 4 checks or direct deposits all at once and then after that it will be weekly. I don't think they update those messages, mine seem to be the same and only changes when I do the weekly certification. Hope this helps.

I have been working a few hours as a freelance consultant but the work is usually done on Thursdays and Fridays. The client company had Christmas Eve/Day and New Year's Eve/Day off and a lot of people took vacation so it was decided that we would just regroup on January 4th since so many people were going to be out. I filed those weeks as zero partial income earned and received my full UI benefits. This last week I got a note saying that "there was a break in my partial earnings" and I had to call to reopen my claim.
Called on Monday and told to call back on Thur/Fri/Sat because of the days assigned for social security numbers. Called first thing Thursday and got the high volume of calls call back message.
I am assuming they just want to make sure that I did not quit or get fired from a part time job and want to know what the break in partial earnings was?
I'm still working as freelancer for that client and we hit the ground running this week.
Any thoughts?
Sharing what I found out for others.
In Mass, if you show two weeks of partial earnings followed by two weeks of no earnings, your account is automatically suspended and you have to call.
At first she was going to make me wait while she confirmed with the company that I was still working.
When I explained the dates and that I have a 1099 contract, all of a sudden she said "You have a 1099 IC contract? I am re-opening your claim."
So I just refile on Sunday as normal.
I found that she was very suspicious at first and then as we talked, she got nicer and was very nice at the end. I guess they must get a lot of people who try to get away with stuff so they have to start out that way. A friend who is also on UI had the same impression.
Hopefully when I go in on Sunday, everything will work fine.
I was recently separated from my job for the first time in late 2009.
I filed on December 23rd and have not heard anything in response from DUA at this point.
Does anyone have a sense of average turn around time lately? This week will mark 3 weeks since my filing, and just want to get a sense of when I might expect to hear. I am filing my weekly claims and have verified that my former employer returned the necessary paperwork.

I was laid off on a Wednesday. I filed the next day and completed my online claim that first Sunday, but didn't qualify for benefits that week because A. I had made too much money in those three last days and B. there is a one week waiting period.
I filed my weekly claim the following Sunday and got no money because that was the official one week waiting period. The week before did not count as the waiting period because I did not qualify for benefits due to the three days of earnings.
I filed again on the third Sunday since I was laid off and received my first check two days later.
I would think you would start receiving a check for filing today. If not, call them back.
The first week I was eligible to file an initial claim was the week of December 20th. I did so on Wednesday the 23rd, which was my assigned day to call based on my social security number.
I've filed weekly claims online for the week of the 27th, January 3rd, and January 10th.
I received my initial information packet, but have not heard anything since. My claim is still listed as processing.
I appreciate the advice. If I don't hear anything by tomorrow, or Wednesday-I will give them a call back.
Can anyone advise. I was laid off in June 09. I am on my 3 week extension which is approved for 20 more weeks. I am very worried as I have applied for several jobs but have no leads. Does anyone know what happens after this extension run out? Is there any other way to file for more UE benefits?

unemployed on December 3rd, filed an unemployment claim on December 7th, haven't received any money as of today. this is my 6th week of being unemployed.
My work is seasonal and every winter i get laid off. Also, every year it takes longer and longer to receive any money from the state.

Just a quick update for others who are waiting.
I JUST got my monetary benefit determination letter at the end of last week, which was 3 weeks from the date I filed my initial claim. I was eligible to begin filing, and did so the week of 12/20.
I suspect they may be backed up in processing due to the New Year. I'm heading into my fifth week of claiming benefits without any money as of yet. I'm going to call this week to see if I can get an update.

Great idea, great site! I have received more info here in minutes than all the hours on hold with MA. Work Force Developement. I am a construction supervisor receiving the full $628 weekly benefit. I was laid off in Feb. 09. I have gone through my intial 26 weeks and my 20 week EB. I am now just starting to receive the 13 additional weeks that will put me into mid april. If I apply for career training before my one year aniversary in Feb. I will be intitled to 24 additional weeks of benifits. My question is, what will happen to the 10 weeks of the 13 that I did not use? I understand that if you qualify, there is up to 79 weeks of benifits. Is the 24 weeks for retraining part of that 79 weeks?

I am collecting unemployment benefits. And right now i am during my extension of benefits. I have a chance to get 1 week contract on 1099 form.
How it is affects my extended benefits( which is during the process. Will i be get paid for the following week after contract ends?
I am in the same boat that you are in. Unfortunately, there is not much one can do when the benefit year expires other than file anew, and wait the 3-5 weeks that I was told by the UI office in Quincy. I suggest working with your creditors like I am doing and really tell them what is happening and the DUA's time period for making a decision and sending you your checks are completely out of your control. Sorry to suggest IOUs, but the state truly does not care about your bills unless they are elected officials who want your vote on Election Day. Also, visit your local UI office every other week for status updates and offer to do anything that you can to help expedite the process. Good Luck.
My question is, if he lays me off again in 3-4 months and I file for a new unemployment claim, will unemployment hold the other 1099 contract with Company B against me and not let me collect again?
I've left a message with my accountant to ask the same question but it is tax season so it may be a few days before I hear back. I guess if unemployment will hold Company B 1099 against me if I get laid off again in 3 months, then I will just have to stay 1099 with Company A and suspend my current claim for three months. (The one problem is that I have to travel for company A and they will pay me mileage but not for my time on the road which would be 3-4 hours a day.)
I still intend to keep looking for a new job in the middle of all of this!
Though I have been certifying weekly, I have not received any more checks.When I certify, the message comes up that I have exhausted my benefits, but this has been coming up ever since I started my new extension.
Has anyone else had such an interruption or cessation of payment without notification?
As you know, it is impossible to speak to a human on the phone regarding UI.
